points. one of the issues was tax cuts, specifically cuts for high-income americans. >> i will not reduce the share paid by high-income individuals. i know that you and your running mate keep saying that, but it's not just not the case. i've got five boys. i'm used to people saying something that's not true and hoping i'll believe it. but that is not the case. >> for 18 months, he's been running on this tax plan. and now five weeks before the election, he's saying that his big, bold idea is never mind! and the fact is if you are lowering the rates the way you describe, governor, then it is not possible to come up with enough deductions and loopholes that only affect high-income individuals to avoid either raising the deficit or burdening

the middle class. >> according to a poll by cnn, 67% of americans believe that mitt romney won the first debate. that's compared to 25% who think president obama won. this poll from cnn only asked 430 registered voters. kron4 asked people over facebook. 59 those responding said president obama won, 29% said mitt romney won. 6% believed it was a tie. 5% did not care. team comprehend of the debate continues. parties were held all over the bay area tonight, first to supporters of president obama. >> reporter: nearly 600 people packed temple nightclub wednesday to watch president obama face off wednesday mitt romney. the debate was played

on four jumbo screens. the club was at capacity, so some had to wait outside until the crowd inside thinned out. everyone who attended support the commander in chief. some say they wanted more detailed answers from the president, and the former massachusetts governor. >> i think mitt came out stronger in the beginning than we expected. things started to even out. i'm did a very good job of bringing up specific differences. >> i think romney basically touted figures and numbers that he promised but with no backup. >> i wanted to know about the educational system and how we were going to make a difference in improving it over the next few years. and i think that both of them were generally vague. >> i think barack obama won the

debate. i think mitt romney was well-prepared. i didn't feel like he answered any questions. >> viewing parties also held by republicans tonight. the scene with the romney supporters this evening in the east bay. >> reporter: here in walnut creek, it was a fullhouse as romney supporters gathered to listen to the first debate. for the most part, everyone believes mr. romney did an excellent job. >> i think he's done a fantastic job making his points about programs and what he has in store for the american people, and growth for the middle class. fairness to every american. >> reporter: there was a lot of applause, especially when the focus was about the economy. more specifically about creating jobs. >> i think he's doing right, right now. i think he's telling

a mistrial was declared today in the federal cocaine fraud trial of a san francisco crime lab technician. a natural

judge says the jurors in the trial did not reach a unanimous verdict on the charges. the jurors agreed that she did take cocaine from the lab in 2009 but disagreed on whether prosecutors proved that she did so by means of deception. the judge set a hearing for next week. >> temperatures are dramatically cooler this evening than yesterday. it's here to stay.

a high school student killed by oakland police is getting their first look at the police report detailing what happened. he was shot to death in may. officers say the 18-year-old pointed a gun at them, so they say they had no choice but to fire. the family and civil rights attorney says the police report raises serious questions about the shooting. >>lear given the physical evidence that no shots were fired by him, there's no gunshot residue, and there's no evidence that the gun near him had been fired. so whoever made that statement was wrong. >> the statement reads in part "this release is not intended to address all questions that

exist, but critical issues regarding the investigation, the providing of medical care and aid, lab results, the coroner's report, and independently corroborated facts and circumstances on the scene are addressed through this release." the oakland police department is also under fire from those who say court-man dated reforms are noting implemented. attorneys will now ask for a furthermore takeover of the police department. >> reporter: for more than 9 years, the oakland police department has been under court order to implement reforms. >> the racial profiling, the identification of problem officers, those are all tasks for which they're still not in

compliance after 9 years. >> reporter: and the citizens of oakland cannot wait any longer. >> people were dying, people are getting injureded, officers who need -- injured, officers who need help are not being taken care of, the department is not being run properly. can't stand by and wait for another "occupy oakland." >> reporter: they will ask a federal judge to appoint a receiver to take control of the oakland police department. >> i would describe him as the compliances forker. that's how i would -- enforcer, that's how i would describe him or her. >> it's a systemic cultural problem that is not being addressed by the city, not being addressed by the city administrator, not by the city council, not being addressed by the mayor. and not being address the most of all by the police department. >> reporter: what does the city of oakland have to say? are they implementing the reforms? that he contacted the police department, and they referred us to the city administrator's office, but they didn't return our calls. we cabbed the
